Terms of Participation
General information
Participation in a giveaway is free of charge and is not geographically restricted.
Giveaways conducted using the QRhing Platform are not lotteries or other games of chance, because participation is free of charge and the prize money is funded solely by the Sponsor.
Information about each giveaway, together with its QR code and the Rules of the giveaway, is published by us on a separate Platform page. A link to that page is embedded in the giveaway QR code. All of this information becomes available to a participant after the participant scans the giveaway QR code with a mobile device camera.
We strive to provide participants with all necessary information about a giveaway. However, we cannot guarantee that the information we publish is complete or sufficient under the laws of the country or countries where the giveaway takes place. For this reason, the Sponsor is responsible for providing participants with all necessary information about the giveaway in accordance with clause 3.8 of the Sponsor Agreement.
Duration of a giveaway
A giveaway ends when the final winning scan of its QR code occurs or when the maximum duration of the giveaway expires.
If the maximum duration expires before all winners have been determined:
- an accelerated winner selection mode is activated. Each subsequent scan of the QR code is then a winning scan until all winners have been determined;
- if the giveaway is private, it also automatically becomes public and is listed in the “Giveaways” section. Following the link to the giveaway will then open an internal Platform page containing its QR code and all information about the giveaway.
Participants
Persons from any country who are at least 16 years old are eligible to participate in giveaways with cash prizes. Users under 16 may use the App only for information purposes and may not participate in giveaways with cash prizes. If the law of a participant’s country of residence sets a higher minimum age for participation, that national age limit applies.
Sponsors and the QR Code Service Provider are not eligible to participate.
Conditions of participation
To participate in a giveaway, a person must scan its QR code using the QRching mobile application (the “App”). To do so, the person must:
- download the App;
- open the Giveaways section on the Website or in the App and follow a link directly to a public giveaway. For a private giveaway, access is provided by the Sponsor;
- scan the displayed QR code using the App.
A person may win only once in a giveaway.
Determination of winners
When the App scans a QR code, the Platform assigns each scan a sequential number within that giveaway and checks in real time whether the scan is a winning one. If it is not, the user receives a corresponding notification in the App. If it is a winning scan, the user receives a notification of the win and must enter the information needed to pay the prize in the App.
Announcement of winners
All winners are published in the “Winners” section of the official website at https://qrching.com/ru and in the App (in the “Winners” section). Each winner receives notice of winning through the App and/or by email.
Types of prizes
Only monetary prizes denominated in rubles, US dollars, euros and bitcoin are awarded.
Payment of prizes
A winner must establish their entitlement to receive the prize by providing correct payment details suitable for making the payment within 30 (thirty) calendar days of being announced as a winner. If the winner fails to provide those details within that period, or provides details that cannot be used to make the payment (including where a payment service or bank rejects the payment), the winner’s right to receive the prize is permanently forfeited. The corresponding amount is added to the Platform’s Guarantee Fund of earmarked funds and retains its earmarked status until actually used for its intended purpose.
Prizes cannot be paid in cash.
The winner is responsible for any tax on the prize in the recipient country.
The QR Code Service Provider is technically unable to track every possible fee charged by the payment systems used. If a payment system charges a fee, that expense is deducted from the prize.
The prize is paid within three business days after the winner provides the information specified in clause 8.1.
A giveaway and its results may be cancelled, and the giveaway declared void, on the grounds set out in the Sponsor Agreement.
Personal data protection
Before providing their personal data to the QR Code Service Provider, users agree to the Privacy Policy.
The personal data of participants in giveaways and winners is used solely for the purposes specified in the Privacy Policy.
A winner may request deletion of their personal data by sending a written request to the QR Code Service Provider. If the prize has not yet been paid to the winner, the winner loses the right to receive it. That amount is considered unclaimed and is added to the Platform’s Guarantee Fund of earmarked funds (held in trust).
The winner’s country and mobile device identifier are published on the official website at https://qrching.com/ru and in the App (in the “Winners” section). This data is anonymous and does not make it possible to identify the winner or create a profile of them.
Legal provisions
Capitalized terms used in these Terms have the same meanings as in the Terms of Use and the Sponsor Agreement.
The giveaway and all mutual obligations of participants and Sponsors arising from it are governed by German law, excluding its conflict-of-laws rules and the UN law on the international sale of goods.
Relations between the QR Code Service Provider (the Rights Holder), participants in giveaways and other Platform Users are governed by the Platform Terms of Use.
Relations between the QR Code Service Provider (the Rights Holder) and Sponsors are governed by the Sponsor Agreement.
Technical failures during a giveaway or communication problems do not constitute grounds for claims against the QR Code Service Provider, the Sponsor or third parties.
Initiating court proceedings in relation to a giveaway is excluded.

The QR Code Service Provider may amend these Terms at any time in accordance with the rules set out in section 3 of the Terms of Use. All amendments and additions take effect within 14 (fourteen) days of publication at https://qrching.com/ru/draws.
